New York State injured workers are not guaranteed a hearing by the Workers Comp Board, making it hard for them to receive benefits. Bill A3671/S845 sponsored by Assembly Woman Pamela Hunter and NYS Senator Andrew Gounardes would require a hearing for every case. The bills are currently in committee in both the NYS Assembly and the NYS Senate respectively.

PURPOSE: The purpose of this bill is to ensure that injured workers receive adequate due process and access to benefits. SUMMARY OF PROVISIONS: Section 1: Amends subdivision 1 of section 20 of the workers' compen- sation law to require the Workers' Compensation Board to hold at least one hearing for every claim.
